BARBERTON, Ohio (CBS Cleveland) – An Ohio teenager has been charged with raping and murdering his 3-year-old sister.

Barberton police say 15-year-old D’Marques Jones raped and killed his half-sister Makayla Jones.

She died of the sexual penetration that caused several of her organs to fail.

A spokesperson with the Summit County Prosecutor’s Office said the court is treating him as a juvenile initially, but a motion filed Thursday morning seeks criminal charges.

Gary Guenther, chief investigator for the Summit County Medical Examiner’s Office, said he could not comment on the autopsy as the case is considered a homicide.

The Beacon Journal reported in June that Jones suffered a five-centimeter rectal tear and air pockets in her abdominal cavity from repeated rectal penetration.

Makayla lived with her three siblings on Iowa Place. The other children were removed from the household and the care of their mother Sarah Robinson. All are cared for by child protective services.

Makayla died in late June after her father Marques Jones brought her in with suspicious injuries, according to a Barberton police report.

The report said D’Marques turned himself in while being accompanied by his attorney Gregory Allen Price. Police have investigated the case for four months.

Calls to Price were not answered.

Jones’ age disqualifies him for the death penalty, but he could spend the rest of his life in prison.
